On December 6th, 2024, the Office of Environmental Health Hazard Assessment of California (OEHHA) published the revised text of California Regulation 65 in official website, which revised sections 25601, 25602, 25603 and 25607.2 of Title 27 of California Regulation, and added new sections 25607.50 to 25607.53. This amendment will take effect on January 1, 2025 and be enforced on January 1, 2028.
The main updated contents of this amendment are:
◆ Short warning requires at least one chemical name to make California 65 short-form warning more informative to consumers. The new short warning words can be used immediately after the regulations are passed.
◆ Provide additional WARNING word options for enterprises to choose, that is, in addition to the original "warning", you can also choose to start with other words, such as "CA WARNING" and "CALIFORNIA WARNING".
◆ Allow enterprises that currently rely on the existing short warning to transition to the new short warning content within three years.
◆ Provide unlimited sales period for products produced before or during the three-year transition period and marked with existing short-format warnings.
◆ Establish a clear safe harbor status for short-form warning content on food.
◆ For products purchased during the three-year transition period, the retailer can update the online short-form warning label within 60 days after receiving the warning or written notice from the manufacturer.
◆ Provide new customized safe harbor warnings for passenger or off-highway motor vehicle parts and leisure ship parts.
◆ The updated short warning label has been enforced since January 1, 2028, and contains about 8-14 words. The font size of 6-point type is still the lower limit of the font size of warning labels. An example of the new short warning label content is as follows:

◆ Products produced and labeled before January 1, 2028 can continue to use the current short-form warning labels whenever the products are sold to consumers, or can be used immediately after the regulations are passed.
